Draft ordinance publication
At the end of 2023, Kofax informed you that Royal Decree 1007/2023 had established mandatory usage of certified software from 1 July 2025 in Spain. You can read further information on the Royal Decree in our previous post here.
The Spanish tax authorities, the Agencia Tributaria, are making rapid strides further to the Royal Decree, via the publication of a draft Ordinance which outlines technical specifications relating to the use of the certified systems, or VERI FACTU systems.
The draft Ordinance is now in public consultation, which is due to expire on 24 January 2024.
The draft Ordinance still needs to be approved and ratified, from which point software developers must ensure their certified billing systems are on the market within a period of 9 months following the approval. However, their usage is currently only mandated from 1 July 2025.
It is important to note that the draft Ordinance is not an e-invoicing mandate. This is projected for 2025, with indications pointing to either the spring or the autumn, but the Spanish government is yet to communicate a precise date for the inception of e-invoicing. The draft Ordinance provides a detailed analysis concerning the requirements computer systems need to adopt to qualify as a certified system, as well as information relating to the standardisation of billing formats that need to be reported to the Spanish tax authorities.
Spain is a compliant territory for Kofax. We are currently analysing the contents of the draft Ordinance with a view to considering our own obligations and capabilities in line with the specified requirements.
